Nexium Trial Moves Forward

There are hundreds of Proton Pump Inhibitors lawsuits which continue to move forward in the U.S. District Court, District of New Jersey. This is the location for claims involving Nexium, Prilosec, and Prevacid causing kidney failure and other life-threatening renal side effects. The pretrial proceeding has begun.

 

About Nexium

Nexium is a proton pump inhibitor (PPI). Patients take it to relieve the symptoms of gastroesophageal reflux disorder (GERD) or commonly known as acid reflux. PPIs, such as Nexium, work by blocking the release of stomach acid. The medicine temporarily coats the esophagus to prevent damage.

The FDA did not approve Nexium for long-term use, and studies confirm that doctors shouldn’t have prescribed 70% of PPI prescriptions. It is one of the most overly prescribed drugs on the market. Nexium is not a “healer” drug and people should not use it for preventive care.

 

Study Links Nexium to Chronic Kidney Disease

Roughly, 15 million Americans use PPIs every year. Out of these, 20-50% is at a higher risk of chronic kidney disease compared with nonusers. The study published in JAMA Internal Medicine warned not to take Nexium at all or to use only for the shortest possible duration. Those that increased their dosage also increased their risk for kidney disease. Kidney disease occurs when the kidneys lose their ability to filter blood effectively. This can lead to end-stage renal failure, which is the need for life-long dialysis treatment or even a kidney transplant.

 

Nexium Litigation

NexiumAlmost 300 cases are pending in the U.S. District Court, District of New Jersey. Just this past August, hundreds more were moved there from the Southern District of Illinois. Now, the trial is going forward. According to court records, the proceeding issued its 4th Case Management Order on October 24, following its October 11 Case Management Conference. A Case Management Order refers to the schedule of proceedings involved in a case before the court. Each stage of the process has a scheduled timeframe in which it must be filed with the court or completed.

This Order directs the parties to submit the following by November 2:

  • An Order regarding Electronically Stored Information
  • An Order regarding a Privilege Log
  • Proposed Case Management Order Addressing Production of Product Identification and Injury Diagnosis Records
  • A Direct Filing Order

The next conference is on November 8 at 1:00 p.m. The parties are to submit a Joint Status Report and Agenda to the Court by November 2.
