Fresenius Will Pay $250M to Settle GranuFlo Lawsuits

It is a great day for our clients and American consumers in general. The attorneys at The Michael Brady Lynch Firm worked tirelessly for years to make sure those affected by GranuFlo would receive justice. Today, they got it! Manufacturer, Fresenius, has agreed to pay $250 million to GranuFlo’s victims. Plaintiffs must agree to the terms of the deal by July 2016, and the funding will be provided in August of 2016.

GranuFlo is a dialysate, which is a fluid used during dialysis to clean the blood. In March 2012, the FDA recalled the compound to revise the prescribing instructions and update labeling. According to the recall, use of the product could lead to low blood pressure and cardiac arrhythmia even leading up to cardiopulmonary arrest and death.

Shortly thereafter, it was discovered that Fresenius was aware of the heart risks and failed to inform healthcare providers and patients. A November 2011 internal company memo surfaced revealing that over 900 patients experienced heart attacks in company clinics the previous year. Fresenius medical personnel concluded that patients with excessive levels of bicarbonate in their blood were six times more likely to experience cardiac arrest than those with normal levels. The memo directly linked GranuFlo, which uses a powdered compound that creates bicarbonate, to increased bicarbonate levels and heart attacks.

Fresenius knew about the risks and did not warn anyone despite the fact that more than 100,000 dialysis patients received Granuflo each year. The FDA has launched a formal investigation to determine if any federal laws were broken.
