It is absolutely horrifying to read about beloved family members being physically abused, raped or neglected. Millions of Americans have loved ones in long-term care facilities. So, many find themselves wondering how they can protect those they love from facing a similar fate. Especially since it is so common. CNN found the federal government has cited more than 1,000 nursing homes for mishandling or failing to prevent alleged cases of rape, sexual assault, and sexual abuse. Nearly 100 of those facilities received citations multiple times over a three-year span.

About Nursing Home Abuse

nursing home abuseEach year in the United States, an estimated 2.1 million seniors are the victims of some form of abuse. Many elderly do not report the abuse or neglect. Unfortunately, abused elders die earlier than those who are well cared for. According to the Assisted Living Federation of America (ALFA), the maltreatment and abuse of the elderly is a significant problem among the elderly population in America. It is more common in women over age 80. Abuse victims are at a 300 perfect increase of dying within three years. Unfortunately, only 1 out of every 6 elderly persons report the event.

Protecting Family From Nursing Home Abuse

So, what can families do? Use the national registry of Medicare-funded nursing homes to learn of facility rankings. Plus, the search will list citations from the last three years for sexual or other forms of abuse. However, since the elderly don’t report abuse frequently, a facility may appear safe. Therefore, frequent check-ins on family members could help lessen the chance of abuse. Plus, ask the nursing home whether all staff, volunteers, and vendors have had criminal background checks.
Just be cautious of any information received. A bad facility is good at rebuffing legitimate questions. But, your loved one has rights. Any nursing home or facility that receives funds from Medicare or Medicaid, and nearly all do fall under federal law. The law says every 90 days every resident receives a medical exam by a medical doctor or physician’s assistant. Some states like California insist on the exam every 60 days.
Federal law clearly lays out the rights of residents and the responsibilities of the facility. If you feel those are not being met, contact a knowledgable attorney like those found at The Michael Brady Lynch Firm. A great complex litigation expert and vigilance could save someone you love.
