Key Legal Issues and Implications

Depo-Provera, a contraceptive injection widely used by women to prevent pregnancy, has been the subject of numerous lawsuits in recent years. [1]
Manufactured by Pfizer, Depo-Provera contains the hormone progestin, which prevents ovulation and alters the uterine lining. While effective as a birth control method, concerns over its side effects have led to a wave of litigation.

This blog explores the background of the lawsuits, the health risks associated with Depo-Provera, and what this means for both consumers and the pharmaceutical industry. [2]

Signature Injury Criteria

The primary health risks associated with Depo-Provera, and the most commonly cited in lawsuits, are bone density loss, brain tumor, and meningioma. [3]  Prolonged use of Depo-Provera has also been linked to a decrease in bone mineral density, which can result in osteoporosis and increase the risk of fractures. The U.S. Food and Drug Administration (FDA) even issued a black-box warning in 2004, cautioning that long-term use of the drug could cause irreversible bone loss, particularly in adolescents and young women. [3]

Lawsuits

The lawsuits allege that Pfizer failed to adequately warn users of the potential for these serious side effects. Plaintiffs argue that had they been informed of the risks, they would have opted for alternative contraceptive methods. These lawsuits are typically based on claims of failure to warn, negligence, and product liability. [4]
