Introduction
According to floridahealth.gov, Stachybotrys chartarum is a toxic type of black mold that releases mycotoxins when there is an elevated amount of moisture inside the home.[1]
Injuries
Certain factors, such as temperature, pH, and humidity, play a role in whether this type of toxic mold, expand or contracts. When this mold is present in the home, injuries, such as, “cold-like symptoms, rashes, sinus inflammation, eye irritation and aggravation of asthma . . . and more general – such as inability to concentrate or fatigue,” become apparent to the residential homeowner or renter.[2]
Rights as a Tenant
Generally, in Florida, a tenant living under these type of black, mold conditions can withhold rent from landlord, if the landlord chooses not to attempt to remedy the living conditions[3]. These living conditions include meeting, the basic structural and healthy inspections that are required of owning a property in the state of Florida. This includes things like fixing leaky roofs and broken heaters and making sure that the property is well-maintained.
