Reform Bills Introduced for Child Sexual Abuse Litigation

Throughout the years, child sexual abuse litigations such as the Boy Scouts of America and the Archdiocese claims have had statute of limitations reforms.

Reform Bills

As of September 10, 2021, child sex abuse statute of limitations reform bills have been introduced in many states.

Twelve states have introduced new statutes of limitations reform law to their legislature. Those states are Nevada, Arizona, Colorado, Arkansas, Louisiana, Minnesota, Iowa, Tennessee, Kentucky, New York, Hawaii, and Maine.

Fourteen states have passed statute of limitations reform bills. These states include New Mexico, Texas, Oklahoma, Kansas, South Dakota, North Dakota, Wisconsin, Michigan, Indiana, Ohio, South Carolina, Georgia, Florida, Delaware, New Jersey, Rhode Island, Massachusetts, Connecticut, Maryland, and Washington DC.

In addition to all of these states, over 35 have introduced new statute of limitation reform bills. Not all have passed, but it does indicate an upswing in the openness of the legislature to create lookback windows for child sex abuse survivors.

Revival or Window Bill

There are 24 states that currently have or are introducing to their legislature a revival or window bill that will allow a lookback window for a child sex abuse survivor as an exception to the statute of limitations.

Those states include Maine, New York, Minnesota, Michigan, Pennsylvania, Indiana, Ohio, Nevada, Colorado, Hawaii, North and South Dakota, Iowa, Arkansas, Kansas, Oklahoma, Texas, Georgia, Louisiana, Kentucky, Maryland, Delaware, Rhode Island, and Massachusetts.
