Mass Tort Litigation Updates: September 2024

In the past few months, there have been significant updates to several of the most prominent mass tort cases currently in litigation. Paragard

Victims have sued Paragard manufacturer Teva Pharmaceuticals for damages related to injuries related to arm breakage during the IUD’s removal. These injuries include uterine infections, infertility, PID, and uterine wall penetration. In some cases, women must have invasive surgeries, such as total hysterectomies, to remove the broken IUD safely.

The Paragard defense team filed a motion on September 12, 2024, to dismiss 236 complaints due to the statute of limitation requirements in six states and by the statute of repose in four other states. The defendants also sought to dismiss 26 other complaints for inaccurate or incomplete information regarding the Paragard placement and removal dates. These complaints may be amended if they aren’t entirely dismissed first. The first bellwether trial is set for October 28th. There are currently 2,793 cases as part of the MDL as of September 2024.

Camp Lejeune

Military members and civilians who lived or worked at Camp Lejeune, North Carolina, between 1953 and 1987 may have experienced adverse health effects due to contaminated water, such as kidney cancer, bladder cancer,  breast cancer, myeloma, leukemia, Hodgkin’s lymphoma, Parkinson’s, ALS, and birth defects.

In 2022, President Biden signed the Camp Lejeune Justice Act, which allowed former base residents to file claims for injuries related to water contamination with a two-year look-back window. This window closed on August 10th, so we can no longer accept Camp Lejeune cases. More than 320,000 cases have been filed against the U.S. Navy.

As litigation moves forward, the first trial won’t be held until 2026. This delayed timeline and the restriction of only allowing bench trials have plaintiff legal teams suggesting settlement may be the best course of action for victims.

Elmiron

Several medical studies have linked Elmiron (the brand name of Pentosan) to vision problems like pigmentary maculopathy and macular degeneration. Many Emiron patients are unaware they are suffering from a macular disorder, assuming their vision is deteriorating with age. Litigation for Elmiron cases has decreased over the last few months, with 1,454 active cases, down from the total record of 1,983. This may mean cases are settling privately and confidentially. Ozempic

The MDL against Ozempic is in the early stages of litigation. Recently, new reports have linked Ozempic usage with Nonarteritic Anterior Ischemic Optic Neuropathy (NAION), also referred to as eye stroke. Symptoms include sudden blurry vision, losing vision in one eye, and experiencing dark spots or floaters. Blindness is also a side effect. Due to these new reports, we are now accepting cases of victims who suffered blindness or eye stroke after taking Ozempic.
