Lien Resolution After Settling a Personal Injury Claim

In the context of a personal injury case, a lien gives a third party the right to be paid from your settlement for the expenses they covered on your behalf, often including medical expenses, future medical care, or disability services. These parties can include health insurers, Medicare, Medicaid, medical providers, or workers’ compensation insurance. [1]

 The Lien Resolution Process:  

1. Identification:

 The first step in the lien resolution process is to identify any liens that exist. This is usually done by exploring your medical record, insurance EOBs (Explanation of Benefits), and direct communication with health insurance providers. [2]

 2. Verification:  

Once potential liens have been identified, they must be verified. This involves confirming that the charges listed are related to the injury and are valid per the language of current laws and the specific insurance policy. [2]

 3. Negotiation:  

Once liens have been identified and verified, they often can, and should, be negotiated. It’s essential to remember that many liens are overstated or can be reduced. Negotiating liens down can save considerable amounts of money and provide a larger net settlement for the client. Legal Implications: Lien resolution isn’t just a financial concern; it’s a legal obligation too. An unsettled lien could result in lawsuits against the beneficiary of the settlement or even the attorney involved. The consequences of neglecting lien resolution are severe and should be taken very seriously. [3]
