A mesothelioma widow filed a wrongful death lawsuit against Union Carbide in June of 2011. The widow accused the chemical company of causing her husband’s malignant mesothelioma, which took his life. A New Jersey Appellate Court gave the go-ahead for the lawsuit saying that the company’s shipments of asbestos to the plant her worked were enough to tie his mesothelioma to his workplace.

While working at the plant for Union Carbide, the victim handled their products from 1969 to 1984. The products at the plant were full of asbestos for nearly the 40 years the victim worked there. Not only did he handle the asbestos-laden products but also worked in a place dubbed the “powder room”. There he would mix raw ingredients including asbestos. The company denied all allegations and said there was a warning label against inhalation.
However, the jury wasn’t buying it. At 74-years-old, the plant worked had mesothelioma and died. The jury felt his life was cut short and awarded his widow $2.1 million to compensate for her husband’s pain and suffering, as well as $150,000 for her loss of his companionship and $130,000 for past and future impact.
