A passenger onboard Prince Cruise Line’s Ruby Princess is suing the company for the injuries she sustained while in her room aboard the ship. Also, besides being injured, the passenger did not receive proper medical care.
Passengers Can Now Get Justice for Medical Malpractice
Previously, state and federal courts ruled that injured parties could not sue the cruise lines for any cruise medical malpractice. However, recently, the 11th Circuit Court of Appeals overturned the longstanding rule. According to the court, the prior rule was outdated. Modern cruise ships have luxury amenities. These include state-of-the-art medical facilities and even intensive care units. Because of this, there is no reason not to expect the same medical care found onshore. The court found no reason to protect cruise lines from medical malpractice claims.
More than half of people who seek medical care on a cruise ship are over the age of 65. Also, a large percentage have chronic or pre-existing medical conditions that necessitate medical treatment. Therefore, cruise ship marketing material tout their state-of-the-art medical facilities. However, they fail to mention that their doctors may not be licensed to practice medicine in the United States.
Princess Cruise Medical Malpractice
According to the complaint, the passenger filed in U.S. District Court for the Central District of California against Princess Cruise Lines Ltd. the passenger was aboard the Ruby Princess. There, defective bed coverings caused her foot to become entangled. Then, she tripped and fell. The passenger fractured her right wrist. Then, she experienced shock and injury to her nervous system, mental, physical and emotional pain and suffering. Then, when she attempted to receive medical care from the onboard physician, he informed her that her injury needed immediate emergency surgical intervention. However, no one medically evacuated the passenger.
