CR Bard Composix Kugel Mesh Hernia Patch

C.R. Bard designed and marketed mesh implants, which have caused painful injuries and many harmful side effects. Having a hernia can be horribly painful and difficult to manage. However, when you couple that with the excruciating abdominal pains associated with a defective hernia patch, it can become almost too much to bear.

About Composix Kugel Mesh

Manufactured by Davol, a C.R. Bard subsidiary, Composix Kugel Mesh patches were designed with a “memory recoil ring”. This ring allowed the patch to be folded before inserted through a small abdominal incision. Then, when it was in place, the patch would spring open to flatly cover the affected area.  Unfortunately, many patients had the ring buckle or break under the stress of placement. This caused many painful, life-threatening and potentially fatal complications.

Composix Kugel Mesh Side Effects

Warning signs of hernia mesh failure include fever, abdominal tenderness, nausea, diarrhea, abnormal bowel movements and abdominal distention. However, there are other serious side effects attributed to mesh failure. These include:

  • abdominal abscess formation
  • abdominal tenderness
  • bowel paralysis or obstruction
  • ring migration through the abdominal wall
  • perforation of intestinal walls
  • distended abdomen
  • external fistulas
  • fluid in the abdomen
  • internal fistulas
  • intestinal or bowel perforation
  • pelvic inflammatory disease
  • peritonitis
  • persistent surgical site drainage
  • sepsis
  • severe persistent abdominal pain

Ring Failure

There are many reasons why the ring design failed. The weld on the ring is too weak along with the folding method that doctors use during insertion. Then, over a 5 year period, the elasticity degrades. Researchers followed up with 21 receives of Composix Kugel and found that four had wrinkled or crumpled ring along with bowel perforation.

Bard Knew the Risks

An uncovered internal email from 2005 admits that the weld on the product breaks as it ages. In fact, the whistleblower wants to replace all the rings with an absorbable material. The employee then goes on to say that he doesn’t know how to justify it financially. C.R. Bard did not know how to justify your safety against their profits.

Safer designs were feasible. Ventrio and Ventralex have absorbable rings in 2008 and 2013 respectively. The degradation of the rings over time causes horrible pain not just from the stiffening but the bacterial adherence. Also, the material releases particles that could cause cancer.

Warnings Still Not Adequate

Currently, the warnings for Composix Kugel only warn about possible complications like a seroma, adhesion or inflammation. The warnings do not say that the ring can degrade over time and cause horrible pain. Also with the degradation, the warnings do not let clients know they have an increased risk of cancer.

Furthermore, it is your right for manufacturers to inform you about the long-term risks associated with the medical devices, and it is the responsibility of manufacturers to provide this information. Hernia Mesh Litigation

In 2014, Bard agreed to pay $21 million to resolve 500 lawsuits in its first major settlement.  Later in 2014, U.S. District Judge Joseph Goodwin warned Bard against taking more cases to trial. With more than 3,000 cases remaining against the company and a precedent of multi-million dollar verdicts, Bard could have been forced into bankruptcy if it did not settle the remaining cases.

Bard recently added $337 million to it’s $660 million reserves for lawsuits, according to a Bloomberg report. There are still over 2,200 cases in the Rhode Island Superior Court under Judge Gibney. Depositions are expected to begin in Fall 2018. Judge Gibney wants to fast-track the cases and get victims justice within six months.
