CR Bard Hernia Mesh Settlements

Bard, and its subsidiaries for the design, manufacture, and use of specific hernia mesh devices.
- In 2005, a jury awarded plaintiffs $1.5 million, who had the Kugel Patch injure them.
- In 2011, Bard settled with more than 2,000 plaintiffs for a total of $184 million. However, Bard did not have to admit liability. Therefore, litigation with Bard continues as the mesh implanted in patients years ago continues causing complications.

In 2014, Bard agreed to pay $21 million to resolve 500 lawsuits in its first major settlement. Later in 2014, U.S. District Judge Joseph Goodwin warned Bard against taking more cases to trial. With more than 3,000 cases remaining against the company and a precedent of multi-million dollar verdicts, Bard could have been forced into bankruptcy if it did not settle the remaining cases.
Bard recently added $337 million to it’s $660 million reserves for lawsuits, according to a Bloomberg report. There are still many cases in the Rhode Island state court.
This is why Judge Edmund A. Sargus granted a motion to consolidate remaining C.R. Bard hernia mesh cases filed nationwide. The initial filing had 54 cases pending in 17 different states. However, within one month of filing, cases doubled. Also, there are over 1,600 Bard hernia mesh lawsuits pending in Rhode Island. Rhode Island is the home state of Bard’s subsidiary Davol
