Zostavax, a vaccine to help prevent shingles, has been hurting consumers in 2006. Now, the hundreds of lawsuits filed by injured consumers from around the country will be consolidated into a single multi-district litigation.
Zostavax vaccinates against shingles. Shingles are the same virus that causes chickenpox. Whereas chickenpox affects the younger population, shingles occur in those over 60. Approved by the FDA in 2006, it was the only shingles vaccine until 2017 when Shingrix came on the market. Zostavax works by a doctor injecting a patient with a weak, living form of the varicella-zoster virus. The varicella-zoster virus causes chickenpox and shingles. However, with the vaccine, the body produces antibodies to fight the weak virus strain. This strengthens the body’s immune system to fight shingles.
Many people are filing against the manufacturer, Merck. Injured people say the live virus in Zostavax led to developing shingles along with severe side effects ranging from vision loss to death. Even one man lost his ability to walk while another lost her right eye. On August 2, 2018, the Judicial Panel on Multidistrict Litigation ordered several Zostavax lawsuits filed in courts across the country including, Pennsylvania, New Jersey, New York, Wisconsin, and Massachusetts to be consolidated in Pennsylvania. Merck’s facilities are in Pennsylvania. These cases will form multidistrict litigation (MDL) 2848. This is to help speed up the litigation process as the number of cases grows. Per the defense’s request, Judge Bartle will preside over the MDL. Judge Bartle has handled many MDL cases.
The MDL order does not apply to lawsuits brought on behalf of 300 plaintiffs in California state court and 800 plaintiffs in New Jersey state court.
