Judge Rules Insurance Liable for Paying NJ/NY Asbestos Injuries
New York Judge Eileen Bransten ruled that the insurance company, American Home Assurance Co. must pay the claims. These stem from hundreds of workers who became ill after asbestos exposure during the original construction of the World Trade Center.

For more than 25 years, American Home defended and settled asbestos injury claims against the Port Authority of New York and New Jersey and the various contractors. They worked on the original World Trade Center building and the trains underneath. However, in 2012, the company declared no obligation to cover any claims involving injuries diagnosed by medical professionals after the policy period ended. These policies in question were from 1966-1976.
Judge Bransten ruled against the company. She stated that the company can’t deny coverage to the thousands of people affected. When American Home issued the policies, it was under the guise that they would pay all sums related to any bodily injury stemming from the World Trade Center project. Judge Bransten found that nothing in the policy indicates that a claimant’s injury has to occur during the policy period for coverage to be available.
