NJ Supreme Court Decision Strengthens Consumer Rights

Finally, some good news to report on the judicial front.
Kendall v. Hoffman-LaRoche is an excellent decision from the NJ Supreme Court on the statute of limitations and discovery rule in pharma cases, declining to adopt any warnings adequate as a matter of law analysis and with some promising words on the rebuttable presumption of adequacy, noting it is not absolute and is rebuttable.
