Bayer Roundup Products Liability Litigation Update

Introduction

Here at the midway point through June 2022, the Bayer Monsanto Roundup Litigation still has over 40,000 unresolved claims by claimants with NHL, or non-Hodgkin’s lymphoma, due to being exposed to the herbicide. To make matters worse, many of the Roundup attorneys are complaining that there is no standard working protocol for the settlement framework of each individualized settlement offer. Thus, more plaintiffs are taking their cases to trial to obtain the amount of compensation that they rightly deserve.[1]

Additionally, the Bayer Roundup lawyers are negotiating individually with each law firm for settlement, which is creating all of the confusion inside of the defense framework. At this current point, juries have awarded multi-million dollar verdicts against Bayer in three different Roundup trials.

Many plaintiffs’ attorneys are now fighting back against Bayer’s corrupt settlement offers and proposals. Bayer’s key arguments surround the legal theory of federal preemption and a reputation for the claims that its glyphosate herbicide leads to NHL. It is appealing all failure to warn cases on the grounds of federal preemption as a tactical maneuver to prohibit future cases from piling on top of the already 40,000 cases that they are currently litigating.[2]

However, plaintiff attorneys counter arguing that it is a cheap manipulation of the judicial system for them to attempt an appeal on these grounds, as stated in an April 20, 2021 letter to the United States Court of Appeals in Atlanta. It further stated, “that Bayer is ‘paying Carson to appeal and then threatening him if he does not follow through.”

Bayer has offered to pay up to $11.6 billion to resolve existing Roundup lawsuits from approximately 125,000 consumers in the U.S. and future claims. New lawsuits are being filed almost every day.
