Hernia Mesh MDL Forms in Rhode Island
Victims of hernia mesh will soon have their day in court. This week a judge granted a motion to form the Hernia Mesh multi-district litigation (MDL) against C.R. Bard in the U.S. District Court for the Southern District of Ohio. Judge Edmund A. Sargus will preside. A multi-district litigation combines cases from other states into one litigation.
About Hernia Mesh
C.R. Bard designed and marketed mesh implants, which have caused painful injuries and many harmful side effects. Having a hernia can be horribly painful and difficult to manage. However, when you couple that with the excruciating abdominal pains associated with a defective hernia patch, it can become almost too much to bear. C.R. Bard has multiple different hernia patches that they produce.
Hernia Mesh MDL
In April, many law firms combined their efforts and filed a motion to form a Hernia Mesh MDL. The MDL consolidates C.R. Bard hernia mesh cases filed in federal courts nationwide. The initial filing had 54 cases pending in 17 different states. However, within one month of filing, cases doubled. Also, there are over 1,600 Bard hernia mesh lawsuits pending in Rhode Island. Rhode Island is the home state of Bard’s subsidiary Davol
Included types in the Hernia Mesh MDL include 3DMax, 3DMax Light, Composix, Composix LP, Marlex Bard Mesh, PerFix Plug, PerFix Plug Light, Sepramesh, Ventralex, Ventralex ST, Ventralight ST, Ventrio, and Ventrio ST.
Past Hernia Mesh Litigation
In 2014, Bard agreed to pay $21 million to resolve 500 lawsuits in its first major settlement. Later in 2014, U.S. District Judge Joseph Goodwin warned Bard against taking more cases to trial. With more than 3,000 cases remaining against the company and a precedent of multi-million dollar verdicts, Bard could have been forced into bankruptcy if it did not settle the remaining cases.
Bard recently added $337 million to it’s $660 million reserves for lawsuits, according to a Bloomberg report. There are still many cases in the Rhode Island state court.
