The Michael Brady Lynch Firm Files Zofran Cleft Lip Lawsuit

Today, the nation mass tort litigation practice of The Michael Brady Lynch Firm filed a new lawsuit on behalf of a Massachusetts family against GlaxoSmithKline LLC in the United States District Court for Massachusetts. The family asserts that GSK’s anti-nausea prescription drug Zofran caused their daughter to be born with a devastating craniofacial defect.

Court filings reflect that the client ingested Zofran in 2006 during her first trimester of pregnancy as a treatment for morning sickness.

GSK marketed Zofran to doctors and soon-to-be mothers as a safe treatment for morning sickness without conducting clinical trials to determine whether Zofran was safe for the unborn children. Studies have found a correlation between prenatal exposure to Zofran and an increased risk of birth defects.

After taking Zofran to treat her morning sickness in 2006, our client’s daughter was born in 2007 with a devastating craniofacial defect. The child was diagnosed with a cleft lip, which causes many complications, including, but not limited to feeding difficulties, a risk of ear infections and hearing loss, speech and language delay, and a dental problem. The child has had to undergo multiple surgeries and invasive procedures in an attempt to correct her birth defect. Future additional surgeries are also likely.

Our client asserts that had she known of the unreasonable and increased risk of birth defects linked to Zofran, she would not have taken Zofran during her pregnancy and her daughter would not have suffered from this life altering birth defect.
